Jericia Renee Marie Hayes, 36, has been in jail in lieu of $70,000 bond since being indicted Jan. 8 on two counts each of sale of fentanyl and delivery of fentanyl alleged on Aug. 22 and Sept. 1, 2022, following an investigation by state, county and city law enforcement agencies.
Monday Hayes was served with a new indictment charging second-degree murder and possession of less than .5 grams of a Schedule II drug (fentanyl).
Hayes appeared before Cumberland County Criminal Court Judge Gary McKenzie Tuesday for arraignment. Crossville attorney Kyle Cokkinias, previously appointed in the drug case, was appointed in the new charges and entered a not-guilty plea on Hayes’ behalf. The case was continued to Sept. 17.
The Tennessee Bureau of Investigation issued a press release Tuesday following arraignment. The release said Crossville Police responded to a Sept. 14, 2021, 911 call to a Willow St. residence where Samuel Mashburn, 35, was found lying in the driveway dead.
An autopsy determined Mashburn died from acute combined multiple drug intoxication.
The resulting investigation led police to allege Hayes — a friend of the victim — “supplied the fentanyl to him,” the press release stated.
Last month, Hayes appeared in Cumberland County Criminal Court, and the drug charges were continued to Sept. 17. Her bond on those charges was set at $70,000.
A grand jury is a panel of qualified, randomly selected citizens who review evidence and verifies that those presenting cases had probable cause to believe that a crime has been committed. It is not a finding of guilty or innocence. All defendants are presumed innocent until proven guilty through due process of the law.
The following indictments were also returned by the grand jury Monday. Unless otherwise noted, arraignment will be held Sept. 17.
Superseding
A superseding indictment is a legal document that replaces a grand jury indictment previously returned. Superseding indictments are a way errors in dates, charges, misspellings and other defects are corrected. Normally, the charges remained unchanged and as with all indictments, superseding indictments are not findings of guilty but a legal process that allows further legal review of accusations.
